Please read these Terms and Conditions (hereinafter: “Terms”) carefully before participating in the Fe/male Switch Gamepreneurship open beta Game, http://femaleswitch.com website and the Fe/male Switch web application http://femaleswitch.app (hereinafter: the "Service") operated by Fe/male Switch and/or Prickly Bits Ltd (hereinafter: FMS).
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the Terms then you may not access the Service.
Introduction
Fe/male Switch is a data-driven educational role-playing game for future female entrepreneurs that gives you all the skills you need to launch your startup, become a solopreneur, learn how to become a mentor or an investor and above all master digital tools and get a startup mindset. It is targeted at women and girls, those that identify as such, or those that just want to have fun while gathering entrepreneurial skills. We need more women entrepreneurs, but we of course welcome everyone, especially those interested in gender intelligence. Just know that the Game Roles are all female, due to the nature of the game and you need to adhere to this.
Game
The service contains an open beta Game. All participants should be aware that this means that the Game is also used for testing and to gather feedback. FMS cannot be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of this open beta Game.
User Guidelines
Users shall use the name they use in daily life. The information you will provide must be accurate. In Game you can use an alias. You are allowed to use no more than one account. Do not share your password or account with others.
FMS is a startup-oriented role-playing game. In the game, you may use your real company as an example if it is still in the startup phase (36 months or less).
We welcome an entrepreneurial spirit. We indeed understand that if you have something to sell, you might want to sell it within the game and/or FMS community as well. However, you should always ask permission from our Game Masters before you offer goods or services within the game and/or platform.
Users can be banned for:
- being younger than 18 years of age without prior consent;
- using the platform without adhering to the rules;
- using the platform to sell your stuff;
- engaging in such a way that it can ‘stir the pot’ such as discussions regarding politics/war;
- not playing in the Game Role, especially the perspective ‘female’, as the game is intended to be a safe space for women;
- any behavior that we forgot to mention but we do not like, if continued after a warning (if the behavior is severe enough, we can decide to ban without a warning, this at the discretion of FMS).
Content
Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content you provide, in terms of IP rights, and all other legal matters.
All copyright and Intellectual Property of the Content you provide and which is legally yours will stay yours. FMS will not claim any copyright or other IP rights solely based on the fact that you provided it as Content in the Game.
Data
We reserve the right to gather data from both the personal data you provide to us as well as the Content. We will treat this data securely (see our privacy statement) and will not sell this data as such.
Artificial Intelligence
FMS uses artificial intelligence. Whenever you see the name “Elona” or “Elona Musk” know that Elona Musk is not a human being, but a strong female driven by artificial intelligence.
We use OpenAI (https://openai.com/policies/terms-of-use) and are therefore bound to incorporate part of their Terms:
Restrictions. You may not (i) use the Services in a way that infringes, misappropriates or violates any person’s rights; (ii) reverse assemble, reverse compile, decompile, translate or otherwise attempt to discover the source code or underlying components of models, algorithms, and systems of the Services (except to the extent such restrictions are contrary to applicable law); (iii) use the Services to develop foundation models or other large scale models that compete with OpenAI; (iv) use any method to extract data from the Services, including web scraping, web harvesting, or web data extraction methods, other than as permitted through the API; (v) represent that output from the Services was human-generated when it is not; or (vii) buy, sell, or transfer API keys without our prior consent. You will comply with any rate limits and other requirements in our documentation. You may use Services only in geographies currently supported by OpenAI.
Copyright and Intellectual Property
All copyright materials and other Intellectual property that will be provided through, with and in the Service may only be used for the sole purpose it was provided for, i.e. usage for the Game only.
Links To Other Web Sites
Our Service may contain links to third-party websites or services that are not owned or controlled by FMS.
FMS has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that FMS shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will endeavor to notify you at least 7 days prior to the effective date of any new terms. What constitutes a material change will be determined at our sole discretion.
Jurisdiction
Dutch law is applicable to FMS, the Service and the Game. Any disputes should be presented to the court in Roermond.
